I can’t even imagine what you are going through. I have no idea what you should expect them to pay, that is something that you will have to discuss with your lawyer. They will come up with a $ amount for you.
Workers’ compensation insurance is a complicated business. Sorry to hear you are still having pain. You are entitled to see a different doctor to evaluate your pain. It could be something else needs to be done, or you need therapy or something else. Eventually your doctor will make a determination about whether or not you can go back to your job. Depending on which state you live in you will either get a settlement or other method of financial compensation for your loss of earnings power. You are entitled to future care for your injury if you don’t fully heal up or you need something like crutches or a wheelchair.
Your state will have an advice website somewhere that will tell you a lot about the workers’ compensation system.
Attorneys can definitely help some workers. The drawbacks are that you share your compensation with them as payment to the attorney. Some patients that get tangled up with attorneys seem to get so into the role of being sick that they have a hard time getting well.
You can also complain to your state’s worker safety enforcement organization that your employer knew about the safety hazard and did not take steps to mitigate the hazard. This could get them in legal trouble.
The best thing you can do is try to heal up and get on with your life. Otherwise you may have money but be totally miserable. Caution is in order. Good luck.
